Risk of Loss
All items purchased from WaveMonkey are made pursuant to a shipment contract. This basically means that the risk of loss and title for such items pass to you upon our delivery to the carrier. You can protect against this kind of loss by choosing to ship via courier or purchasing postage insurance.

Product Descriptions
WaveMonkey and its associates attempt to be as accurate as possible. However, WaveMonkey does not warrant that product descriptions or other content of this site is accurate, complete, reliable, current, or error-free. If a product offered by WaveMonkey itself is not as described, your sole remedy is to return it in unused condition.

Liability
WaveMonkey’s total liability herein in respect of each event or series of connected events shall not exceed the total price paid for the purchase of products and/or services under the “Terms and Conditions”.

The customer shall indemnify WaveMonkey and keep WaveMonkey fully and effectively indemnified against any loss or damage to any property or injury to or death of any persons caused by any negligent act or omission or wilful misconduct of the Customer, its employees, agents or sub-contractors or by any breach of its contractual obligations arising out of “Terms and Conditions”. WaveMonkey and Customer agree that WaveMonkey will not be liable for Products not being available for use/sales. WaveMonkey shall not be liable to the Customer for any incidental, indirect, special or consequential damages arising out of or in connection with the purchase, use, or performance of products or services, even if WaveMonkey has been advised of their possibility.

Any service response times stated by WaveMonkey in the service and sales contracts are approximate only and WaveMonkey shall not be liable for any direct or indirect loss or damage arising from its failure to meet such response times, howsoever occasioned.

Any typographical, clerical or other error or omission in sales literature, quotation, price list, acceptance of offer, invoice or other documents or information issued by WaveMonkey, shall be subject to correction without any liability on the part of WaveMonkey.

Disclaimer of Warranties and Limitation of Liability
THIS SITE IS PROVIDED BY WAVEMONKEY ON AN “AS IS” AND “AS AVAILABLE” BASIS. Applicable Law
By visiting WaveMonkey, you agree that the laws of the state of NSW Australia, without regard to the principles of conflict of laws, will govern these “Terms and Conditions” and any dispute of any sort that might arise between you and WaveMonkey or its associates.

Dispute
Any dispute relating in any way to your visit to WaveMonkey or to products you purchase through WaveMonkey shall be submitted to confidential arbitration in North Sydney NSW Australia, except that, to the extent you have in any manner violated or threatened to violate WaveMonkey’s intellectual property rights, WaveMonkey may seek injunctive or other appropriate relief in any state or federal court in the state of NSW Australia, and you consent to exclusive jurisdiction and venue in such courts. Arbitration under this agreement shall be conducted under the rules then prevailing of the Australian Arbitration Association. The arbitrator’s award shall be binding and may be entered as a judgement in any court of competent jurisdiction. To the fullest extend permitted by applicable law, no arbitration under this Agreement shall be joined to an arbitration involving any other party subject to this Agreement, whether through class arbitration proceedings or otherwise.
